1. Acceptance of Terms

By accessing or using Archly (archly.ai), operated by Fraktal Design Studio, you agree to these terms. If you do not agree, do not use the service.

2. Service Description

Archly provides AI-powered image, video, and 3D model generation tools. The service operates on a pay-per-use credit system. Credits are non-transferable and non-refundable except where required by law.

3. User Responsibilities

You must be at least 18 years old to use the service.
You are responsible for maintaining the security of your account credentials.
You must not use the service to generate illegal, harmful, or infringing content.
You must not attempt to circumvent rate limits, credit checks, or other security measures.

4. Intellectual Property

You own the outputs you generate through Archly, subject to applicable AI model licensing terms. The Archly platform, brand, and interface are the intellectual property of Fraktal Design Studio.

5. Credits & Payments

Credits are consumed per generation based on the model and parameters used.
Payments are processed securely through iyzico payment gateway.
Failed generations may result in automatic credit refunds at our discretion.
Prices and credit costs may change with notice.

6. Refunds & Cancellation

Archly is a digital service delivered instantly upon payment. In accordance with Turkish Distance Contracts Regulation (Article 15), the right of withdrawal does not apply to digital content and services that are delivered immediately in electronic form.

Purchased credits are non-refundable. Since credits are delivered to your account instantly upon payment confirmation, no "change of mind" refunds are available.
If an AI generation fails due to a technical error, the credits consumed are automatically refunded to your account.
In the event of a duplicate or erroneous charge, contact us at hello@archly.ai. Confirmed errors will be refunded via the original payment method.
Upon account deletion, any remaining credits are forfeited.

7. Limitation of Liability

Archly is provided "as is" without warranty. Fraktal Design Studio is not liable for AI-generated output quality, service interruptions, or indirect damages. Our total liability is limited to the amount you paid in the last 12 months.

8. Governing Law

These terms are governed by the laws of the Republic of Turkey. Disputes shall be resolved in the courts of Ankara.

9. Distance Sales Agreement

This section constitutes the Distance Sales Agreement as required by Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

Price: As displayed on the pricing page at the time of purchase. All prices include applicable taxes.

Payment Method: Credit card / debit card via secure payment gateway (3D Secure verified).

Delivery: Credits are delivered instantly to the buyer's account upon successful payment. No waiting period.

Right of Withdrawal: Per Article 15 of the Distance Contracts Regulation, the right of withdrawal does not apply to this service as it is a digital service delivered instantly in electronic form upon the buyer's explicit consent at checkout.

Complaints: hello@archly.ai. For unresolved disputes, the Consumer Arbitration Committee in the buyer's province has jurisdiction.
